Terms Of Service

Weekly Trash Pickup Agreement (Residential)

 

*NO TIRES, NO PAINT, NO CHEMICALS, NO BATTERIES*

 

This Weekly Trash Pickup Agreement (“Agreement”) is made as of the date this agreement has been electronically signed, by and between Dependable Disposal Services, having its principal place of business at Clinton, TN (hereinafter referred to as “Company”), and the entity or individual named on the electronically signed invoice, representing the property at the address listed on the signed invoice (“Customer”).

 

Trash Containers

– **Containers Provided: ** Only trash placed inside the Company-provided 96-Gallon trash container will be picked up. The Company is not responsible for personal trash containers and lids that are lost or damaged.

– **Maintenance and Fees: ** Customers are responsible for the cleaning of the trash containers. There will be a fee for any container needing repair or replacement due to negligence or misuse.

– **Ownership: ** Trash containers remain the property of the Company and are provided to Customers for the duration of the service.

– **Additional Cans: ** Additional cans can be added to customer accounts for an additional fee. $20 per month for another can provided by Dependable Disposal Services.  $15 per month for an additional can provided by the customer (must be a commercial grade can, similar to the one that was provided)

 

Setout Requirement

– **Placement Time: ** Customers must have their trash containers at the agreed location no later than 4 a.m. on the pickup day. Failure to do so will result in waiting until the following week for trash pickup, with no reimbursements or credits issued.

– **Placement Of Can: ** The can must be no farther than 4 foot from the road with the opening of the lid facing the road (handle towards the house).  The can must not be placed close to the mailbox, another can or any other objects. 

 

Content Regulations

– **Prohibited Materials: ** Customers are fully responsible for the contents of the container. Hazardous materials and certain “Unacceptable materials” as defined under applicable laws, such as tires, chemicals, paint, and batteries, are strictly prohibited. These items will incur a minimum charge of $25.00 per item if found in the trash container and may be returned to the Customer at their expense.

– **Liability for Improper Disposal: ** Customers will bear all costs, fines, and penalties for disposal of prohibited contents, which may include cleanup and legal fees.

 

Safety Considerations

– **Handling of Dangerous Items: ** Customers must ensure sharp objects and large pieces of glass are disposed of safely as specified in the Agreement to prevent injury.

 

Weekly Pickup Service

– **Schedule and Large Items: ** Trash will be picked up once a week on the designated day. Large items that do not fit in the container must be disposed of separately by the Customer or through prior arrangement with the Company.

 

Weather Cancellations and Delays in Service

– **Service Adjustments: ** Service may be delayed or canceled due to weather or other uncontrollable circumstances, with no adjustments to billing.  These updates will be posted on our website (ddstrash.com) and our facebook page. 

 

Holidays

– **Non-service Days: ** No service will be provided on major holidays such as Memorial Day, Labor Day, Thanksgiving, Christmas Eve, and Christmas Day, with advance notice provided for alternative pickup days. Please check email, facebook page or website (ddstrash.com)

 

Payments and Invoices

– **Billing and Late Fees: ** Payments are due on the first business day of each month (per your quarterly billing cycle). A late fee of $10 is applied after the 10th day and services will be suspended. A $2 charge applies for payments made over the phone.

– **Returned Payment Fees: ** A $3 fee applies for returned auto draft credit card payments, and a $15 fee for ACH returns.




Service Cancellation

– **Procedure for Cancellation: ** Customers wishing to cancel must notify the Company in advance via phone call or text (865-266-9101) or by email ([email protected]).  The trash container will be removed upon cancellation. It must be left at the road, empty, until it is picked up. 

 

Indemnification

– **Liability: ** Customers agree to indemnify the Company against losses due to breach of this Agreement.

 

Agreement and Notice

– **Modification and Governing Law:** This Agreement can only be modified in writing signed by both parties and is governed by the laws of Tennessee.

 

Electronically Signing Agreement

– **Consent: ** By electronically signing, Customers agree to the terms and acknowledge that they are binding.

 

This Agreement contains the entire Agreement between the Company and the Customer and supersedes all prior agreements and understandings. The Company’s contact number is (865) 266-9101.
